SUMMARY OF BENEFITS UNDER SICK BENEFIT PLAN TO QUALIFY FOR SICK BENEFITS

A Member to qualify for sick benefits, must be under the care of, and following the instructions of a licensed medical practitioner during the period for which application for benefits is made.

To qualify for benefits from the first day of disability, a Member must be under the care of i.e., seen, clinically assessed and treated within two days following the first date of disability claimed by a licensed medical practitioner.

In the event that a Member's disability commences the day preceding a statutory holiday or on a statutory holiday and/or weekend, payment for this period will be made provided they are clinically assessed by a licensed medical practitioner on the first day following these said periods.

Telephone treatment/consultations or instructions will not be accepted under the provision of this By-law. Note the following examples:

  • Member sick on Monday, must be clinically assessed and treated no later than Wednesday.

  • Member sick on Friday, must be clinically assessed and treated no later than Monday.

  • Member sick on Saturday, must be clinically assessed and treated no later than Monday.

  • Member sick on Sunday, must be clinically assessed and treated no later than Tuesday.

Certificates of licensed medical practitioners are required on claims for sick benefits. However, certificates by dentists will be accepted for disabilities arising from dental conditions. Also, certifications will be accepted for periods not in excess of three weeks in any 12-month period, for chiropractors, chiropodists, podiatrists, or osteopaths who are recognized by OHIP. Periods in excess of three weeks will be accepted if accompanied by a referral statement signed by a licensed medical practitioner.

BENEFIT RATE
The TTC Sick Benefit Association will pay 75% of the base rate at the commencement of each separate period of absence for which a member qualifies for sick benefits.

PAYMENT OF CLAIMS
All applications to the Association for payment of sick benefits must be made within 90 calendar days from the first day of disability.


MAXIMUM PERIOD PAYABLE (PRIOR TO JANUARY 1,1994)

Sick benefits shall be payable for a maximum period of 1040 hours for any one disability. 1040 hours is calculated as follows:

Members scheduled to work 5 days per week guaranteed 8 hours per day, 40 hours per week, maximum period = 130 work days.
Member scheduled to work 4 days per week guaranteed 10 hours per day, 40 hours per week, maximum period = 104 work days.
Member scheduled to work 3 days per week guaranteed 13.33 hours per day, 40 hours per week, maximum period 78 work days. (Wheel-Trans only)

CONTINUATION OF PAYMENT
When a member is in receipt of sick benefits and an Attending Physician's Statement is forwarded to the Member's home address by mail, ensure that this specific medical certificate is fully completed by the treating physician and returned in order to continue benefit.


GENERAL

Members absent and eligible for benefits during November and December and who have unused vacation entitlement, will be required to use up their vacation before the end of the year.
