Local 113 and the Toronto Transit Commission, have agreed to the following changes to the TTC Sick Benefit Association.
  • Effective April 15, 2005 to December 31, 2005
3 Days No Medical Note Required
Members of the TTC Sick Benefit Association will be eligible for sick benefits the first 3 days of absence as noted in the above effective dates, for sickness or injury without the requirement of a medical note. Once the first 3 days have been utilized, the Member is required to be treated by a doctor within 48 hours in order to be eligible for sick benefits.

EXAMPLE

In this example, the Member utilized all 3 sick days therefore does not require a medical note. If the Member reports sick any other time during the 2005 calendar year, the Member must see a doctor within 48 hours from the date the Member reports sick.

5 Days No Medical Note Required
Effective January 1, 2006: Members of the Sick Benefit Assocation will be eligible for sick benefits the first 5 days of absence in each calendar year of sickness or injury without the requirement of a medical note. Once the first 5 days have been utilized, the Member is required to be treated by a doctor within 48 hours in order to be eligible for sick benefits.

In this example the Member will be paid for the first 5 sick days, however in order to receive SBA benefits for the 6th day and 7th day, the Member must see a doctor within 48 hours from the 6th day. Both examples apply from January 1, 2006.

HOW TO CLAIM WITHOUT A MEDICAL NOTE
To make a claim against the "Non Medical Days," Members are required to complete the "Top Half" of the Sick Benefit Application Form and forward to the Administrative Staff. Please ensure that all the questions have been answered, and that the Members signature is on the form.
1st day no longer deducted
By-law 4 Section 1 (2) states in part:

"For the third and subsequent incidents of illness in a calendar year, the first day will be deducted."

Effective April 15, 2005

The above wording has been deleted. Members will no longer be deducted the first day on the third and subsequent absence for disabilities resulting from illness under 10 workdays.

SUBMITTING AN APPLICATION FOR SICK BENEFITS
By-law 1, Section 15 (2)

Effective April 15, 2005

Applications to the Association for payment of benefits shall be made within 60 calendar days of the date of absence.

SICK BENEFIT ADVANCES FOR WHEN A MEMBER IS INJURED AT WORK
Effective April 15, 2005

If a Member sustains an occupational injury and applies for benefits under the Workplace Safety and Insurance Act (“WSIA”) and the Workplace Safety and Insurance Board (“WSIB”) does not make a decision regarding the claim within 10 business days from the date of the Employer’s Report of Injury/Disease (Form 7), the Member may apply for SBA Advances.

lf a Member is assaulted by a customer or witnesses a suicide while in the course of employment and applies for benefits under the Workplace Safety and Insurance Act (“WSIA”) and the Workplace Safety and Insurance Board (“WSIB”) does not make a decision regarding the claim within 3 business days from the date of the Employer’s Report of Injury/Disease (Form 7), the Member may appry for SBA Advances.

In the case of a 3rd party claim, a Member may be eligible for S.B.A. Advances upon submission of the signed ”Election to Claim Compensation” Form.

SICK BENEFIT ADVANCES WILL BE GRANTED IF:
Member is cooperating with the WSIB’s requests for information.

• Member submits the appropriate Sick Benefit Association Application Form(s}.

• Member agrees to reimburse the TTC Sick Benefit Association for any double payment for the same period by signing a “Direction to CIaim’ Form.
